communicate with us through any channel, including telephone and SMS/text messaging.

SMS and Telephone Communications (10DLC Compliance)

IMPORTANT NOTICE REGARDING TEXT MESSAGES AND CALLS: By providing your mobile
phone number to Propylender, you are providing express written consent to receive communications
as described in this section. Message and data rates may apply.

4.1 Express Written Consent

By providing us with a telephone number for a mobile device — including any number you later
convert to a mobile number — you expressly consent to receiving the following types of
communications from Propylender, its affiliates, and agents:
• Automated or manually dialed calls
• Prerecorded or artificial voice message calls
• Text messages (SMS and MMS), including marketing messages
• Calls and texts made using an automatic telephone dialing system (ATDS)
This consent applies to each mobile phone number you provide to us, now or in the future, and
covers communications about any product or service offered by Propylender.

 

4.2 Types of Messages We Send

• Transactional messages: loan application updates, document requests, appointment
reminders, payment notifications, and account alerts
• Informational messages: rate updates, policy changes, and service announcements
• Marketing messages: promotional offers, new products, and referral program updates
(only with your prior express written consent)

 

4.3 Message Frequency

Message frequency varies based on your activity and preferences. You may receive up to
several messages per week. We will not send messages outside of reasonable business hours.

 

4.4 Message and Data Rates

Message and data rates may apply. These charges are billed by your mobile carrier and are
your responsibility. Propylender does not charge for SMS communications, but your carrier’s
standard rates apply.

 

4.5 How to Opt Out / Unsubscribe

You may revoke your consent to receive SMS/text messages at any time using any of the
following methods:
• Text STOP, QUIT, CANCEL, END, or UNSUBSCRIBE to any text message we send you
• Email us at crmsupport@propylender.com with your name, phone number, and opt-out
request
• Call us at +1 (305) 230-4357 during business hours
• Log in to your account and update your communication preferences
After opting out, you will receive one final confirmation message. Opting out of marketing
messages does not opt you out of transactional or legally required communications related to an
existing loan or application.

4.7 Not a Condition of Service

You understand and agree that consent to receive calls and text messages is NOT a condition
of obtaining any product or service from Propylender. You may decline to provide or revoke your
consent at any time without affecting your ability to apply for or receive a loan, except that
certain account-related communications may be required for servicing an active loan.

 

4.8 Monitoring and Recording

Calls with Propylender may be monitored and recorded for quality assurance, training,
compliance, and security purposes. By calling us or receiving a call from us, you consent to
such monitoring and recording.

Florida All-Party Consent Notice: Security of Communications Act, Fla. Stat. § 934.03. Propylender records telephone calls in
compliance with this statute. Your continued participation in a call with our representatives
constitutes your consent to recording under Florida law. If you do not consent to being recorded,
please notify our representative at the beginning of the call and we will make reasonable
accommodations.

 

4.9 10DLC Registration

Propylender’s SMS messaging program is registered under the 10-Digit Long Code (10DLC)
framework as required by the mobile carrier industry. Our messaging is compliant with The
Campaign Registry (TCR) requirements and applicable CTIA guidelines. We do not engage in
spam messaging and maintain an active opt-out mechanism for all campaigns.

How We Share Your Information

Propylender does not sell your personal information to third parties. We may share your
information in the following circumstances:

5.1 Service Providers

We share information with vendors and service providers who perform services on our behalf,
such as credit reporting agencies, title companies, appraisers, IT and cloud service providers,
customer support platforms, marketing platforms, SMS/telephony providers, and payment processors. These parties are contractually obligated to protect your information and use it only
for the purposes for which it was disclosed.

 

5.2 Affiliated Companies

We may share information with Propylender’s subsidiaries and affiliated entities for purposes
consistent with this Privacy Policy.

 

5.3 Legal and Regulatory Disclosures

We may disclose your information as required by law, including to comply with subpoenas, court
orders, government investigations, or applicable regulations such as those enforced by the
Consumer Financial Protection Bureau (CFPB), Federal Trade Commission (FTC), or state
financial regulators.

 

5.4 Business Transfers

If Propylender is involved in a merger, acquisition, financing, or sale of business assets, your
information may be transferred as part of that transaction. We will notify you of any such change
in ownership or control of your personal information.

 

5.5 With Your Consent

designed to protect your personal information from unauthorized access, use, disclosure,
alteration, or destruction. These measures include:

Despite our best efforts, no security system is impenetrable. In the event of a data breach that

the Florida Department of Legal Affairs when a breach affects 500 or more Florida residents.

Loan-related records are retained in accordance with applicable federal and state requirements, which may be up to seven (7) years or longer. When information is no longer needed, we securely delete or anonymize it.

You may request access to, correction of, or deletion of your personal information by contacting

9.2 Opt-Out of Marketing Communications

You may opt out of receiving marketing emails by clicking the “unsubscribe” link in any
marketing email or by contacting us directly. You may opt out of marketing text messages as
described in Section 4.5 above.

 

9.3 California Residents — CCPA Rights

If you are a California resident, you have the following rights under the California Consumer
Privacy Act (CCPA):


• Right to Know: Request information about the categories and specific pieces of
personal information we have collected about you
• Right to Delete: Request deletion of personal information we have collected (subject to
exceptions)

data and to access that data in a portable format.

• Right to Correct: You have the right to request correction of inaccurate personal data
we maintain about you.
• Right to Delete: You have the right to request deletion of personal data you have
provided to us or that we have collected about you, subject to exceptions for data we are
legally required to retain.
• Right to Data Portability: You have the right to obtain a copy of your personal data in a
format that is technically feasible to transmit to another controller.
• Right to Opt Out: You have the right to opt out of the processing of your personal data
for purposes of targeted advertising or profiling. Note: Propylender does not sell
personal data and does not process personal data for targeted advertising through third-
party ad networks.
• Right to Non-Discrimination: We will not discriminate against you for exercising any of
the rights described in this section.

day extension available where reasonably necessary. We will not charge a fee for responding to
your first request in any 12-month period.

If we use consumer reports in connection with your loan application, you have rights under the
Fair Credit Reporting Act, including the right to know if information in your file has been used
against you and the right to dispute inaccurate information. For more information, visit

9.6 Protection of Rights

The Equal Credit Opportunity Act (ECOA), 15 U.S.C. § 1691 et seq., and its implementing
regulation, Regulation B (12 C.F.R. Part 1002), prohibit creditors from discriminating against
credit applicants on the basis of race, color, religion, national origin, sex, marital status, age
(provided the applicant has the capacity to enter into a contract), the fact that all or part of the
applicant’s income derives from any public assistance program, or the fact that the applicant
has in good faith exercised any right under the Consumer Credit Protection Act.

Affiliates — Companies related by common ownership or control. Propylender currently has no
affiliates that receive your NPI for marketing purposes.
Non-affiliates — Companies not related by common ownership or control. We do not share
your NPI with non-affiliates for marketing purposes.
Joint marketing — A formal agreement between non-affiliated financial companies to market
financial products or services to you. We do not engage in joint marketing arrangements.
